Withers’ former head of family law has seen ‘a lot of bad-tempered litigation’ in the past year with an unprecedentedly high percentage of cases having gone to final hearings. Julian Lipson wonders whether the added heat has a ready explanation: economic turbulence following the EU referendum result. ‘Husbands are nervous about their financial prospects in a post-Brexit situation and not quite so happy-go-lucky,’ he says.
Lipson specialises in domestic and international financial cases, many of which involve tax and trust implications, substantial assets or incomes. Prenups are also becoming increasingly common among HNWs and those set to inherit wealth. ‘It’s a realistic and healthy way to start a marriage,’ he states. ‘It doesn’t bode well if you are unable to communicate about things of this nature with your spouse.’
Originally a tax lawyer, Lipson moved into family law because he was attracted by the human and strategic element of the work. A peer says he is ‘probably the most reliably excellent family lawyer in London who fights for his clients while being eminently reasonable’. ‘I like sorting people’s messes out,’ Lipson explains. ‘I find the process of relaunching people fulfilling.’
The court system, however, is in chaos, he says: ‘It’s pretty disgraceful: underfunded and understaffed, entirely haphazard.’
